Promotion | Trade Promotion 1 |
Promotion Period | The Promotion commences on Thursday 22 August 2024 at 9:00 am and ends on Friday 29 November 2024 at 11:59 pm. Participants can enter the Promotion only during the Promotion Period. |
Promoter | AKNET Pty Ltd trading as NEXPD (ABN 93 735 286 755) of Unit 9, 51-55 City Road, Southbank, Victoria, Australia. |
Age limit | You must be 18 years of age or older at time of entering the Promotion. You must be a resident of Australia or New Zealand at the time of entry and must not be ineligible clause 4 of the Standard Terms and Conditions. By “resident” we mean Australian or New Zealand citizens and permanent residents. |
Entry Requirements | To enter the Promotion and be eligible to win, participants must either purchase a Membership from the Promoter during the Promotion Period or buy eligible product(s) (either a course, webinar or workshop) valued at over $50 each. |
Maximum number of entries per participant | Participants will automatically receive five (5) entries into the prize draw upon purchasing or renewing a Membership during the Promotion Period.
The number of entries available to a Non-Member Participant will be equal to the number of Eligible Courses purchased by the Non-Member Participant during the Promotion Period. For example, if a Non-member Participant purchases two (2) Eligible Courses during the Promotion Period, then that member will receive two (2) entries into the prize draw. |
Additional entries | If a participant who has purchased a Membership during the Promotion Period also purchases a Live Event, such as a workshop, during the Promotion Period, then the participant will receive an additional entry into the prize draw. |
Prize(s) | iPhone Model 15 There are no bonus or additional prizes other than the Prize. |
Value of each Prize | Valued up to $3000 AUD |
Method and location of determining winner | A winner will be selected randomly using an electronic selector generator. The selection will take place at 236 Proximity Drive, Sunshine West VIC 3020. |
Winner selection date | The winner will be selected on Tuesday 3 December 2024. |
Manner of announcing prize winner | The selected winner will be contacted by phone and email on Thursday 5 December 2024 (Winning Date).The last name, the initial of the first name and the postcode of the winner will be published on the Promoter’s website nexpd.com for 30 days. |
Prize claim period | The winner must claim their prize within 14 days from the Winning Date. Once claimed, the Prize will be delivered to the winner within 14 days. |
Redetermination of prize winners | If the winner forfeits the Prize or fails to claim their Prize by the Prize claim period, then another winner will be selected. If the prize is forfeited or is not claimed by another winner, the Promoter, at its sole discretion, will forfeit the prize, and this information will be published on the Promoter’s website. |
Manner of resolving disputes | If you have any dispute or complaint in respect of the Promotion, then you must write to the Promoter at admin@nexpd.com. The Promoter will respond in writing within five (5) business days from the date the written notice is received. |

Definitions | Eligible Course(s) means a course, webinar, or workshop that is valued $50 or more and is marked as eligible for the trade promotion on the website.Non-Member Participant means a participant who has not purchased a Membership from the Promoter, or a participant who purchased or renewed a Membership from the Promoter but not during the Promotion Period.
Membership means either a full membership, an AG membership or a student membership with the Promoter. Live Event means an event that is happening in real-time, either in-person, virtually or a mix of both, and that is marked as eligible for the trade promotion on the website. |
STANDARD TERMS AND CONDITIONS
- The Standard Terms and Conditions, the Entry Details and any other documents issued by the Promoter together constitute the terms and conditions for the Promotion. By entering the Promotion, participants agree to abide by the terms and conditions of the Promotion.
- The Promotion is a game of chance and entry into the Promotion is automatic where the participant during the Promotion Period satisfies the Entry Requirements.
- The Promoter reserves the right to verify the eligibility of all participants. The Promoter reserves the right to ask for proof of age, identity and residency of any participant including the winner. The Promoter reserves the right to disqualify any participant who tampers with the entry process, breaches these terms and conditions, or engages in any unlawful or improper conduct calculated to jeopardise the fair and proper conduct of the Promotion.
- A participant must not be involved in the management of the Promoter or the conduct or promotion of the Promotion (Involved Person) and must not be a family member of the Involved Person. This Promotion is not open to residents of Northern Territory.
- The participant is responsible for providing correct and up-to-date details while satisfying the Entry Requirements. The Promoter will not be held responsible or liable if the Prize is lost, late or undelivered due to any inaccurate or incomplete information provided by the participant.
- The Prize is not exchangeable and cannot be redeemed for cash. The Prize is not transferable and cannot be transferred to any person.
- If the Prize attracts any tax liability, the participant is responsible for such liability. The promoter will not be liable for any tax liability incurred by the winner or a participant.
- The Promoter is not responsible for any changes in the value or composition of the Prize. The Promoter provides no warranties in relation to the Prize.
- In the unlikely event that the Prize becomes unavailable for whatever reason, Promoter will replace the Prize with another prize of equal value.
- If the winner forfeits the Prize or does not claim it, the Promoter will not provide any payment or compensation in lieu.
- Once the Prize has left the Promoter’s premises, the Promoter will not be responsible or liable for any damage, delay or loss to the Prize. The risk in the Prize transfers to the winner at that point.
- The Promoter, at its sole discretion, may use the winner’s first and last name, and other details, at any time, to promote the Promoter’s future promotions or competitions without any compensation or payment to the winner. The Promoter may ask the winner to provide a headshot of the winner for use in promoting the Promoter’s future promotions or competitions. The winner agrees to provide it and agrees that the winner will not be compensated or paid for the use of the headshot. The winner agrees to execute any agreements, forms or deeds necessary to allow the Promoter to use the winner’s name, details and headshot for promoting its future promotions or competitions.
- The Promoter may ask the winner to attend the Promoter’s premises or any other location to film the presentation of the Prize. The winner agrees to attend and be filmed, and agrees that they will not be paid or compensated for any filming or for the use of the film.
- If the Prize or part thereof is supplied by a third party, then the Prize or part thereof will be subject to the terms and conditions of that third party. The third party and not the Promoter will be responsible for the provision of the Prize. In the event of any inconsistencies between the terms and conditions of the third party and the Promoter’s terms and conditions, the third party’s terms and conditions will supersede the Promoter’s terms and conditions.
- If, for any reason that is beyond the reasonable control of the Promoter, such as computer bugs, computer viruses, malfunction of computer systems, software or servers, unauthorised intervention, fraud, hacking, any other unforeseen circumstances or a combination thereof, the Promoter is unable to run the Promotion in a fair and transparent manner, the Promoter reserves the right to modify, cancel, delay, suspend or terminate the Promotion.
- To the fullest extent permitted by law, each participant, including the winner, releases the Promoter (including its officers, employees, and agents) from any claims, losses, damages, injuries, expenses or costs (including but not limited to direct, indirect, or consequential loss) that arise out of the participant’s participation in the Promotion, connection with the Prize or use of the Prize.
- Nothing in these terms and conditions operate to exclude or limit the participant’s legal rights under the Competition and Consumer Act 2010 (Cth) or other laws.
- Nothing in these terms and conditions grants the participant any rights in the intellectual property of the Promoter, including the Promoter’s trade mark, for any purpose.
- The Promoter will use the participant’s personal information collected as part of the Promotion for the purposes of conducting the Promotion and for any matters connected to the Promotion including using the winner’s details for promotional purposes. The Promoter may disclose personal information to third parties involved in the Promotion.
