The NEXPD Website (located at https://nexpd.com) is owned and operated by AKNET Pty Ltd trading as NEXPD (ACN 735 286 755) (referred to as we/us/our).
These terms and conditions (Terms) govern the access and use of NEXPD Website. Please read all of the important information below. If you do not agree to any of these terms and conditions, please do not continue to use this website. If you are looking to upload and offer your courses on the NEXPD Website, then please refer to this page, https://nexpd.com/contact-us/.
NEXPD Website
NEXPD Website is an intermediary online platform connecting prospective students with providers of professional development, training and educational courses. Through this platform, students can purchase and enrol in courses offered by third-party providers, while these providers can upload and offer their courses to interested students.
Aknet Pty Ltd trading as NEXPD may at times have its own courses uploaded to the NEXPD Website.
For the purposes of these Terms, Course(s) means courses and/or course materials uploaded and offered by third-party providers and/or Aknet Pty Ltd trading as NEXPD including paid or free.
Eligibility
The NEXPD Website can be used by persons aged thirteen (13) years or older. There are no residency requirements, and you can enrol in our Courses from anywhere in the world.
User registration
You must register on the NEXPD Website to access the NEXPD Website and enrol in the Courses. If you do not register, you will not be able to access all features on the application.
We collect the following information when you register with us:
a. Your first and last name;
b. Your postal address (We do not accept PO Box addresses);
c. Your email address;
d. Your mobile number; and
e. Your birth date.
Please note that you cannot change your details at a later stage without contacting our support team. It is your responsibility to ensure that the details you provide are correct. Please check any details carefully before submitting them.
When you enrol in a Course on the NEXPD Website, we will also collect your credit card details and other financial information necessary to process the payments for the Course.
You may also be able to register on the NEXPD Website using Facebook, Google and your Apple ID.
How do we operate?
We have established commercial relationships with various third-parties that upload and offer their Courses on the NEXPD Website. We may also from time-to-time upload and offer our own Courses on the NEXPD Website.
The Courses are available in the form of pre-recorded courses and are always available on demand subject to the Course being withdrawn by the Course Provider or removed from the NEXPD Website.
Once you enrol in a Course, your access will last for 12 months unless the Course is withdrawn by the Course Provider or is removed from the NEXPD Website due to inaccuracies or out-of-date information before 12 months. In the event that the Course is withdrawn or removed, we will provide you with the option of receiving a partial refund or enrolling in a Course of equivalent value and subject matter for the remaining months.
From time-to-time, we will run live webinars and workshops on the NEXPD Website. The scheduled date and times will be advertised on the NEXPD Website, and you are able to enrol in a live webinar or workshop of your choice.
In the event that a particular webinar or workshop does not have enough participants, then we may reschedule or cancel that webinar or workshop. In case of a cancellation, you will receive a refund within 14 days from the day of cancellation. The live webinar or workshop may have its own terms and conditions in addition to these terms and conditions.
While the Courses are designed to impart skills and knowledge into you, we do not provide any guarantees in relation to the level of skills and/or knowledge you will gain from attending the Courses. Likewise, we do not guarantee that you will be able to secure employment of your choice, gain promotion at work and/or boost your earning potential after attending any Course.
You can enrol in a Course of your choice and liking. Once you have enrolled in a Course, you cannot withdraw from that Course.
The Course provider will have their own rules, assignments and deadlines in relation to the Course. You must abide by them. If you miss a deadline and/or need additional time to submit any assignments, then you must contact the Course provider directly.
Upon successful completion of the Course, you would receive a certificate of completion from us. This certificate cannot be used to claim a credit or to claim any professional development points at a College, University or any other educational institution.
We may also host and make available from time-to-time free information and content on the NEXPD Website. This information and content can be browsed and accessed by every user of the NEXPD Website.
Free resources
From time to time, we may upload and make available free resources in the form of webinars, lectures and courses on our website. You will need to create an account with us to access some or all of the free resources.
These resources could be removed from the website at any time without notice to you. We will not be held responsible or liable for any loss, damage, injury or expense suffered by you by the removal of any resources.
All intellectual property rights in the free resources are either owned by us or licensed to us. We grant you a non-exclusive, non-sublicensable, non-transferrable and revocable licence to access the free resources for your personal use only. You cannot download, copy, transmit, reproduce, distribute, or otherwise exploit the free resources without our prior written permission.
You may claim professional development points towards NAATI recertification by accessing some of the free resources. It is your responsibility to download the NAATI PD Catalogue and select the most appropriate category for your recertification. If you have any questions regarding professional development points, then please contact NAATI directly. We do not provide any advice in relation to professional development points.
Podcasts
From time to time, we may upload and make available podcasts on our website. You can access the podcasts for free without needing to create an account with us. You can also subscribe to the podcasts on our YouTube, Apple Podcast, Google Podcast and/or Spotify channels to access them.
We may remove these podcasts from our website or any of the aforementioned channels at any time without any notice to you. We will not be held responsible or liable for any loss, damage, injury or expense suffered by you by the removal of the podcasts.
All intellectual property rights in the podcasts are either owned by us or licensed to us. We grant you a non-exclusive, non-sublicensable, non-transferrable and revocable licence to stream the free resources for your personal use only. You cannot download, copy, transmit, reproduce, distribute or otherwise exploit the podcasts without our prior written permission.
Event tickets
From time to time, we may offer for sale limited number of tickets to various events, online or otherwise. These events are either arranged or conduct by us, in conjunction by third parties or third parties.
Only one person will be allowed per ticket. Event tickets are non-shareable and non-transferrable. You cannot resell or onsell the event ticket to anyone. We will collect your personal details at the time of purchase and your details will be handled in accordance with our Privacy Policy.
If an event is cancelled, then we will provide you with the option to receive a refund or a ticket to the next event of your choice. If an event is delayed or rescheduled, then we will notify you of the changes. We do not provide any refunds for no shows or change of mind.
You are not allowed to record the event using any audio-visual method. If you record or attempt to record the event, then your access to the event may be terminated and you may be prohibited from registering for and attending future events.
Other than the representations provided alongside the event on the NEXPD website, we do not make any additional representations regarding the event. It is your sole responsibility to ensure that you meet the prerequisites of any event before attending.
You must adhere to all rules and codes of conduct set for any event. At a minimum, refrain from using abusive, threatening, vile, disruptive, or racist language against anyone. It is crucial to treat everyone with respect and courtesy. Failure to comply with any rule or code of conduct may result in the termination of your access to the event and possible barring from attending future events.
After the event concludes, a professional development certificate will be issued only to those who have met the specified requirements. It is your responsibility to ensure you meet these requirements to receive the certificate.
Bulk purchasing for organisations
If you are an organisation that would like to purchase the Courses in bulk for your employees, officers, agents or clients, then please contact at admin@nexpd.com.
Acceptable use
When you register with us, we grant you a limited, non-exclusive, personal, non-transferrable, non-shareable, non-sublicensable, revocable licence to access and use the NEXPD Website pursuant to these Terms and any additional terms and conditions set forth by us from time to time.
You can access the NEXPD Website on your laptop or desktop using Chrome or Safari browser for free. You can access and use the NEXPD Website on only 1 device at a time.
You can use the NEXPD Website only for purchasing and enrolling in the Courses. You cannot use the NEXPD Website for any other purpose including any illegal activities. If we discover that you are using NEXPD Website for any illegal or disallowed purposes, then we reserve the right to immediately terminate your access to the NEXPD Website without any liability to you.
If you encounter any issues in using or accessing the NEXPD Website, then you can email our admin support for assistance. You are also able to email the Course Provider directly.
If you have a dispute with a Course Provider, then you can lodge your compliant with us. Upon the receipt of the compliant, we will conduct our own investigations and revert to you with a decision. If we need further information from you, then you agree to provide us with that information in a timely manner. Our decisions are final and cannot be appealed.
Restricted activities
You agree not to:
1. Reverse engineer, extract, decompile, modify, create derivative works of, or otherwise amend the NEXPD Website;
2. Evade any security feature or functionality of the NEXPD Website;
3. Permit any third party to access or use the NEXPD Website;
4. Use any code or application that interferes with the working of the NEXPD Website;
5. Use the NEXPD Website in any manner which is contrary to an Australian law;
6. Provide false information; and
7. Onsell any information obtained from the NEXPD Website, use any data mining robots or other extraction tools or metatag or mirror the NEXPD Website.
Payment
We use the Stripe payment gateway, Paypal and AfterPay to allow you to make a purchase. The payment gateways accepts payment via Visa, Mastercard,.
To the extent permitted by law, we will not be held liable and responsible for any damages or consequential loss (whether direct or indirect) suffered by you as a result of any credit card fraud or use of the payment gateways.
We will not be held liable or responsible for any additional charges imposed by your credit card provider or bank.
As payments are processed through payment gateways including Stripe, Paypal and AfterPay, we do not hold your financial information at any time. If you have any concerns regarding the use, disclosure or deletion of your financial information, then please review payment gateways’ privacy policy.
AfterPay is a buy now pay later platform that allows customers to make purchases and pay them off over time. AfterPay late fees, eligibility and terms and conditions apply to any purchase you make on the NEXPD Website using AfterPay. Intellectual Property Rights
Save for the Courses provided by the third-parties, we own all intellectual property rights (including but not limited to copyright, patents, trade marks (whether registered or unregistered)) in the NEXPD Website and its materials, information and content.
We are also to the exclusive licensees of the Courses and have the rights to make the Courses available on the NEXPD Website and to grant a sub-licence in them.
When you create an account on the NEXPD Website, we will grant you a revocable, non-exclusive, non-transferrable, non-shareable, royalty-free and non-sublicensable licence in the content available on the NEXPD Website to you.
This abovementioned licence is for your personal use only and only for educational purposes. You cannot sub-license it to a third-party. You must not reproduce, adapt, distribute, publish or create similar works from the content available on the NEXPD Website.
You cannot download the Courses but only view and use for educational purposes and cannot disseminate or on-sell it to third parties.
No licence is granted to you either expressly or impliedly in the trade marks, names or logos of the NEXPD Website.
Intellectual property infringement concerns
We respect the intellectual property rights of others. If you believe in good faith that any materials including the Courses on the NEXPD Website infringe your copyright, please send the following information to us at admin@nexpd.com:
● Identification of the copyright work claimed to have been infringed,
● Identification of the material that is claimed to be infringing or to be the subject of infringing activity;
● Your address, telephone number, and email address;
● A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner;
● A statement by you, made under penalty of perjury, such as a statutory declaration, that the information in your notification is accurate, and that you are the copyright owner or are authorised to act on the copyright owner’s behalf;
● A physical or electronic signature of the copyright owner or the person authorised to act on behalf of the owner of the copyright interest.
Social media accounts
From time-to-time, we may operate accounts on various social media accounts such as Facebook, Twitter and Instagram, Linkedin. You can join our social media to get latest updates about our business and connect with other members.
You must be respectful and courteous in your interactions on social media accounts. You must not make any vile, racist, sexist, discriminatory or hateful comments on our social media pages. If you make inappropriate comments on our social media pages, then your access to our social media pages and the NEXPD Website will be terminated.
Data security
We will adopt reasonable cybersecurity practices to safeguard your personal information against cyber-attacks, data breaches and hacks. This includes but is not limited to storing the personal information on secure encrypted servers.
Data sharing
You agree for us to share your name, email address and contact details with the Course provider. The Course provider may use your data for any marketing and or advertising activities.
The NEXPD Website uses functions of various social media platforms. Your personal details will be shared with the social media platform when you use the “share” function to select the social media platform. We have no influence or control over the data that has been shared with the social media platform. If you have any concerns regarding the use, disclosure or deletion of the personal information by a social media platform, kindly review the social media platform’s privacy policy before sharing.
We may from time-to-time publish your details on the “what’s happening” section of the NEXPD Website. Your details may also appear in the enrolled students’ section of the NEXPD Website.
Marketing
By registering with us, you agree for us to send you our newsletter and occasional updates or offers. You can opt-out of receiving any marketing and advertising materials at any time.
Suspension
If you are in breach of these Terms and if the breach is not remedied within a reasonable time period, we reserve the right to suspend your access and use of NEXPD Website.
Termination
We reserve the right to terminate your access and use of the NEXPD Website if you are in a serious breach of the Terms (for example, you on-sell the information made available on this website or if you infringe a third party’s intellectual property rights) or if you repeatedly breach these Terms without any liability to you.
Testimonials
We may from time-to-time send you emails requesting for feedback on the Course you enrolled in. You may at your own prerogative provide us with the feedback. This feedback will be shared on an anonymous basis with the Course provider.
Any review or other matter that could be regarded as a testimonial or endorsement about the NEXPD Website does not constitute a guarantee, warranty, or prediction regarding the outcome of any use of the NEXPD Website and you acknowledge that testimonials represent the anecdotal experience of individual consumers.
Third Party Beneficiary
Third parties that offer and upload their courses on the NEXPD Website are third party beneficiaries of these Terms. Upon your acceptance of these Terms, these third parties will have the right to enforce these Terms against you as a third-party beneficiary thereof.
Limitation of liability
We will not be liable to you for any special, indirect, consequential or punitive damages, including but not limited to loss of profits, loss of business opportunities, or loss of goodwill, arising out of or related to the use of the NEXPD Website, even if advised of the possibility of such damages.
Availability of the website
From time to time, down-time, either scheduled or unscheduled, may occur. We will endeavour to work within reason to ensure the amount of down-time is limited and will not be held liable for the consequences of any down-time.
Links to third party websites
We may from time-to-time upload links to third party websites on the NEXPD Website. These third-party websites are outside our control and we do not have any influence over them. If you choose to follow these links, then you will be doing so at your own risk. We will, under no circumstances, will be liable for any loss, damage or claims that you may suffer by following the third-party links.
Variations
We may vary these Terms by giving you written notice at any time or updating it on our website link.
Jurisdiction and governing law
These Terms are governed by the laws of the State of Victoria, Australia.
Events which are out of control
We shall not be held liable and responsible for any delay in performance of our obligations under these Terms if the delay is caused by circumstances beyond our reasonable control.
Severability
Any provision in these Terms which is invalid or unenforceable in any jurisdiction is to be read down for the purposes of that jurisdiction, if possible, so as to be valid and enforceable. Otherwise, any provision in these Terms which is invalid or unenforceable in any jurisdiction is to be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of these Terms.
Disclaimer
You acknowledge and agree that, to the extent permissible at law this NEXPD Website and all content appearing on it are provided on an “as is” and “as available” basis, without warranties of any kind. To the extent permissible at law, we exclude liability for any loss, damage or injury however caused (including through negligence), which you may suffer in connection with your use of this NEXPD Website, or any other linked website and take no responsibility for any loss arising out of your use of or reliance on information contained on or accessed through this NEXPD Website.
